A. According to art. 160 para. 1 of Law 98/2016, the deadline by which any economic operator interested in participating in the public procurement procedure has the right to request additional clarifications/information regarding the Award Documentation is:
- prthe first deadline is 26 days before the deadline for submission of offers;
- the second deadline is 18 days before the deadline for submission of offers.
B. According to art. 160 para. 2 of Law 98/2016, the Contracting Authority establishes two deadlines in which it will respond clearlyand completely to all requests for clarifications/additional information:
- the first deadline is 20 days before the deadline for submitting offers;
- the second deadline is 12 days before the deadline for submitting offers.
Depending on the complexity of the requestsclarifications addressed by economic operators, for which the answers should be published at the first deadline indicated above, the Contracting Authority reserves the right to publish the answers to the respective clarifications at the second deadline established in the Award Documentation. The terms ofanswers to the clarifications have been established so that the economic operators have an adequate period for the analysis of the Award Documentation and, subsequently, for the elaboration of the offers in the light of the answers provided by the Contracting Authority.
