Description:
The contracting authority will conclude framework agreements for each lot for 12 months, with max. 5 op ec, and subsequent contracts will be concluded and carried out by the beneficiary authority - Gherla Penitentiary. Subsequent contracts are concluded under the following conditions: a) On the date of entry into forceof the agreement, for a period of 3 months, the price is firm, the subsequent contracts will be concluded without resuming the competition, with the promising supplier ranked first after the selection; in the situation where the first promising supplier does not support its price or refuses to conclude the contract subsecvent, he is obliged to demonstrate the impossibility of fulfilling the contractual clauses, the contracting authority having the possibility of concluding the contract with the next ranked, until the exhaustion of the ranking. b) Awarding subsequent subsequent contracts, after the first 3 months from the conclusionthe era of the framework agreement, until its completion, will be done by resuming the competition, organized at the level of the beneficiary contracting authority, its object being the PRICE-the lowest price. Price adjustment in the first 3 months is not allowed. After the first 3 months the price can be adjustedunder the conditions stipulated in the framework agreement. In the cases provided for in art. 118 para. (1) lit. b), the authority for the beneficiary resumes the competition based on the same terms and conditions applied for the award of the framework agreement, detailed where necessary and supplemented if necessary with other third parties...
