Suspense clause:
"The award procedure of the contract of achpublic procurement is initiated under the scope of this suspensive clause, in the sense that the conclusion of the public procurement contract is conditional on the allocation of budget credits for this purpose, the signing of the contract being done in compliance with the provisions regarding the commitment of expensesfrom the budgets that fall under the legislation on public finances. Considering the provisions of Law 98/2016 on public procurement and H.G. no. 395/2016, with subsequent amendments and additions, the Contracting Authority specifies that it will conclude the contract with the bidder declaret winner only to the extent that the funds necessary for the purchase will be secured by allocating budget credits for this purpose. If, regardless of the reasons, the budget credits will not be allocated, within 30 days from the date of approval of the procedure report, the procedure of atribuire will be canceled by law, in accordance with the provisions of art. 212 paragraph (1) letter c) sentence 2 of Law 98/2016 with subsequent amendments and additions, it being impossible to conclude the public procurement contract.
