Contract for providing simulators.
The procedure for awarding the public procurement contract is initiated under the incident of this suspensive clause, in the sense that the conclusion of the public procurement contract is conditioned by the allocation of budget credits for this purpose, the signing of the contractbeing done in compliance with the provisions regarding the employment of expenses from the budgets that fall under the incidence of the legislation on public finances.
Considering the provisions of Law no. 98/2016 regarding public procurement and HG no. 395/2016, with subsequent amendments and additions, UMFCarol Davila from Bucharest as the Contracting Authority states that she will conclude the contract with the bidder declared the winner only to the extent that the funds necessary for the purchase will be secured. If, for whatever reason, the funds related to this procurement procedure do notwill be allocated, for a period of 6 months from the date of approval of the procedure report, the allocation procedure will be canceled by law, provided that there is no other source of funding, in accordance with the provisions of art. 212 paragraph (1 ) letter c) sentence 2 of Law 98/2016
with the amendments and additionslater, it being impossible to conclude the public procurement contract.
