Technical design services for the DTAC and PT CS DE phases, technical assistance from the designer and execution of works for the investment objective "ESTABLISHING A BICYCLE TRACK ON THE BACHUS ROAD IN PRAHOVA COUNTY"
The project will be financed through the "Program for the creation of whip tracksclete" managed by the Environment Fund Administration. In order to accelerate the implementation of the project, the procedure for awarding the public procurement contract is initiated under this suspensive clause, in the sense that the conclusion of the public procurement contract is conditioned byis the allocation of budget credits for this purpose, the signing of the contract being done in compliance with the provisions regarding the engagement of expenses from the budgets that fall under the scope of the legislation on public finances.
Considering the provisions of Law 98/2016 on public procurementas well as HG 395/2016, the contracting authority specifies that it concludes the contract with the winning bidder only to the extent that the funds necessary for the purchase will be secured by allocating budget credits for this purpose. If for any reason the budget credits will not be grantedcate, the contracting authority, after receiving the notification regarding the non-granting of funding, reserves the right to cancel the award procedure, provided there is no other source of funding, in accordance with the provisions of art. 212, para. 1, lit. c, sentence 2 of Law 98/2016, be...
